Montana Credit Repair Laws

Montana consumers wanting to use a credit repair firm to repair their bad credit need to understand the very few credit repair rights under Montana credit repair laws (Mont. Code Ann. §§ 31-3-201 to 31-3-203). The law below pertains to credit repair in Montana.

Who may provide bad credit repair service. Nonprofit or charitable corporations or associations may provide debt adjustment or debt management services. Exceptions: business or person who provides a $10,000 bond, and who charges no more than $75 for processing and documentation and 15% of the total amount owed for debt adjusting; attorneys, CPAs, banks, and title companies as part of regular practice or business; persons acting under court orders; trade and sales associations who adjust debts with business establishments; employers for their employees; and lender who, at the debtor’s request, adjusts debts at no additional cost as part of disbursing the loan funds.

Collection agencies may not provide debt management services.
